Applicable terms and conditions of sale

Preamble

Services Chauffeurs Occasionnels « S.C.O » provides road passenger transport. This simplified joint-stock company (SAS), with capital of €4,500, is registered with the Saint-Nazaire Trade and Companies Register under number 817 698 962 and in the passenger register under licence number 2016/52/0000065.

Article 1: Offer

S.C.O enables private and professional customers to benefit from a service adapted to their travel needs, seven days a week and 24 hours a day, in vehicles carrying a maximum of nine people including the driver.

Article 2: Booking a journey

For every booking, the customer provides their name, telephone number, email address and residential address, together with the date, departure and arrival points, passenger count, luggage and any child or baby seat requirement.

When booking by email, a booking is valid only once S.C.O has sent a confirmation. The customer must check the information in it.

Bookings must be made at least 24 hours before the start of the journey, whether made online or by telephone.

  • Routes are calculated using Google Maps and/or ViaMichelin mapping systems, which are used as references for the final fare.
  • Displayed fares include taxes and apply seven days a week, 24 hours a day. Management may change fares without notice or compensation.
  • The chauffeur may alter the route according to traffic without changing the fare.
  • Services are paid directly to the chauffeur after the journey. Bank cards and cash are accepted.
  • For cancellations less than 24 hours before the service begins, the full amount may be charged.
  • Last-minute changes are handled where possible and may result in supplements or cancellation charges.
  • A final invoice is supplied by the chauffeur on request after the journey.

Article 2.2: Price and payment terms

All booked routes are calculated using Google Maps and/or ViaMichelin mapping systems, which determine the final fare. Fares are based on the route with the fastest estimated journey time.

The S.C.O booking system takes account of journey times based on daily observations of local traffic. Customers must allow sufficient time for their journey; S.C.O cannot be held responsible if traffic makes a journey longer than initially estimated.

For journeys booked from the airport, customers should allow for the time needed to leave the plane and collect luggage before setting the pick-up time.

A booking is deemed accepted only once payment has been validated. Booked services are paid directly to the chauffeur after the journey.

Articles 2.3 to 2.5: Cancellation, changes and invoice

If a customer who has already paid cancels less than 24 hours before the service begins, the full amount may be charged. If management cancels, the customer is informed 24 hours in advance and may not claim compensation.

Last-minute changes are handled where possible and may lead to supplements or cancellation charges. A final invoice is supplied by the chauffeur on request after the journey, whatever its amount.

Article 3: Obligations of the parties

S.C.O uses all reasonable means to take travellers to their destination in the best conditions of comfort and safety and within the expected time.

S.C.O cannot be held liable for delays caused by traffic, road works, accidents, weather, other events or the traveller. Customers must allow sufficient time for their journey.

For airport pick-ups, customers should allow enough time to leave the plane and collect luggage.

After twenty minutes of waiting without prior notification to the office, the chauffeur may consider the booking cancelled and the full service may be charged.

Carrier liability

S.C.O’s liability covers direct bodily injury to travellers from boarding the vehicle until leaving it, excluding those two actions. S.C.O cannot be liable where damage is caused by the traveller, a third party, or the nature of luggage and its packaging.

S.C.O holds professional civil-liability insurance for paid passenger transport. Delays caused by traffic, road closures, accidents, diversions, weather or other events do not give rise to compensation or reimbursement.

Article 4: Miscellaneous provisions

All passengers must wear their individual seat belts. Baby seats and booster seats are supplied free of charge, up to two per vehicle.

No surcharge is applied to luggage within the limit of two 25 kg hold bags per passenger. Large or numerous bags must be declared when booking.

Eating, smoking and carrying hazardous substances are prohibited in vehicles. Forgotten personal items and luggage remain the passenger’s responsibility.

Article 4: Safety and luggage

Damage to the vehicle, including damage caused by inappropriate opening of doors, is the customer’s responsibility. If the chauffeur notices an offence, including use of narcotics, they may stop the service immediately; this does not give entitlement to a refund.

S.C.O may interrupt a service where customer conduct endangers the chauffeur’s safety or dignity, or the company’s image. Fragile, delicate and forgotten items remain the passenger’s responsibility.

Article 5: Complaints, mediation and data

Any complaint concerning the service must be made by email with acknowledgement of receipt. The customer may use conventional mediation or another alternative dispute resolution method, subject to applicable conditions.

S.C.O collects data useful for performing the booking and shares it only with the relevant chauffeurs. Bank data is not stored. Customers have rights of access and objection on legitimate grounds concerning their data.

Data protection

These terms are subject to European Regulation 2016/679 of 27 April 2016. S.C.O collects data useful for booking requests made through the website, by email or by telephone, in order to provide the journey and communicate with the customer.

Data is shared only with chauffeurs so they can provide the service: name, telephone number and addresses. S.C.O does not store bank data and collects only information useful for the proper performance of the booking.

Article 6: Disputes

These terms and conditions are governed exclusively by French law. The Saint-Nazaire Commercial Court has sole jurisdiction in the event of a dispute.

Article 7: Acceptance of the terms and conditions

The customer acknowledges having read these terms when booking. Acceptance of a quote and confirmation of an order imply full acceptance of these provisions. S.C.O may amend them at any time.
